New York requires use New York as "IT-2104, Employee's Withholding Certificate available" or a Form W-4 New York Federal withholding state.

Not all states allow salary reduction under Section 125 cafeteria plans or 401 (k) to be treated the same way the IRS code allows. In the plans of New York, the cafeteria is not taxable to the calculation of tax Income tax for unemployment insurance. 401 (k) plan deferrals are not taxable on the income tax, unemployment tax purposes.

The New York minimum wage is $ 5.15 per hour.

The general provision in New York in overtime in a non-FLSA covered employer is one and a half times the regular rate after 40 hours per week.

Requirements of New York State new hire reports are that every employer must report every new hire and rehire. The employer must inform elements required by the federal government:

  • Social Security Number of Employee
  • Employer Name
  • Business Address
  • Federal Employer Identification Number (EIN)

This information must be reported within 20 days of hiring or rehiring.
Information can be sent as a W4 or equivalent by mail, fax or electronically.

In New York, the laws on the payroll of mandatory rest or meal breaks are only that all Employees must have 30 minutes for lunch 11-2 (60 mill), and another 20 minutes of 5-7, if you leave before 11 o'clock shift and goes after 7 pm 45 minutes during shift of at least 6 hours 1-6 (60 mill).

New York has the following provisions for the deduction of Child Support:

  • When should you start to remember? First pay period after 14 days of service.
  • When you send a payment? Interior 7 days to pay.
  • By sending the notice of termination? "Without delay"
  • Maximum fees? Nothing
  • Maintaining boundaries? Rules Federal CCPA.
